Hayward DUI – With High Alcohol Level

I’ve been practicing criminal law and DUI law in Hayward for over twenty years. I’ve seen a lot of cases. Below I reprinted (with some minor edits) a story that I saw in the local newspaper of a Hayward DUI that caught my interest. Hayward: Driver with blood-alcohol level at 5 times legal limit hit patrol car, police say

HAYWARD — A man who police say was driving with a blood-alcohol content of five times the legal driving limit is in hot water after crashing his car into a parked patrol cruiser and injuring a sheriff’s deputy last week.

The Hayward Driver, 29, was arrested on suspicion of driving under the influence and causing injury following the 5 p.m. crash on Friday near the intersection of 162nd Avenue and East 14th Street, just south of Interstate 580, said Sgt. J.D. Nelson.

The Hayward Driver, whose address was not known, was behind the wheel of a four-door Chevrolet Caprice when he struck a parked Alameda County Sheriff’s Office patrol car as a deputy was getting into it.

The male deputy, who was on duty, suffered head and leg injuries, Nelson said. The Hayward Driver suffered a bloody nose but was not seriously injured.

The Hayward Driver submitted to a breath test at the scene, Nelson said, which showed his BAC level at .40. In California a person is considered legally impaired to drive at .08.

Both the deputy and The Hayward Driver were taken to local hospitals to be treated for their injuries. The deputy was treated and released.

The Hayward Driver was taken to Santa Rita Jail, where records show he recently posted bail.
